Partner Carl Hittinger and Associate Michael Neminksi recently penned an article for The Legal Intelligencer titled “DOJ and FTC Using New Weapons to Attack Antitrust Conduct.”

Published Sept. 29, the piece addresses “aggressive” prosecutions by the Department of Justice and its use of “alternative methods to pursue alleged monopolistic conduct.” The authors write that the Federal Trade Commission is also using alternative methods in its antitrust efforts – and has announced plans to partner with the DOJ on investigations and enforcement actions and with the Department of Labor (DOL) in investigations into unfair labor practices.

“Observers would be prudent to keep a sharp eye on when and where the Antitrust Division of the DOJ files its amicus briefs, and how the DOL and FTC implement their new partnership,” they write.
