Children’s privacy has been the subject of much recent debate in state legislatures and Congress, having been cited as a top priority by the Federal Trade Commission (FTC) and state regulators as well as President Biden during the 2024 State of the Union. The question of what online protections should be afforded to children, including in relation to data use, targeted marketing, and online mental and physical safety, are being duked out in various ways. Who is considered a “child” is part of the debate, leading to a patchwork of laws governing minors under 13, under 15, under 16, and under 18. These privacy and online safety obligations in relation to children’s data create what we call the Children’s Data Life Cycle.

This webinar will explore the Children’s Data Life Cycle (Advertising > Collection of Children’s Data > Legal Obligations). We will focus on practical takeaways, including:

  • What it means to design an online service that is directed to children and the difference between a mixed-audience and general-audience online service.
  • What limitations should be considered when marketing to children.
  • Important differences between current state and federal laws aimed at the protection of children’s data, such as privacy laws, advertising-through-profiling laws, age-design codes, content moderation laws, and social media laws, including age thresholds, scope, “knowledge” standards, and obligations.
  • Practical compliance challenges for businesses, such as age gates, the use of cookies and similar technologies, and conducting risk assessments.
  • Current and future trends, including proposals to watch.
