The conflicting judicial decisions interpreting the Federal Trade Commission’s (FTC) final rule on noncompetes have left employers and employees without meaningful guidance on whether these covenants will remain valid after September 4, 2024. In advance of the FTC Rule’s effective date, we will provide an update on all court decisions that impact the Rule and employers’ obligations.

We expect that a Texas Federal Court will provide further guidance on August 30, 2024.
