Courtney Witten is an accomplished trial attorney who specializes in wage and hour class actions. She offers more than a dozen years of progressive litigation experience, having diligently served the U.S. Department of Labor (DOL), Office of the Solicitor, and the U.S. Department of Justice, Environmental and Natural Resources Division. Courtney has practiced within the U.S. District Court for the Districts of Colorado, Utah, New Mexico, Montana, Northern and Western Districts of Oklahoma, and Northern District of Texas, as well as Federal administrative law courts, such as the Occupational Safety and Health Review Commission, Federal Mine Safety and Health Review Commission and DOL Office of Administrative Law Judges.
During her tenure with the U.S. Department of Labor, Courtney handled all phases of civil litigation in federal district courts and administrative law courts. She served as lead attorney in charge of cases involving anti-retaliation provisions of the Fair Labor Standards Act and guided Wage and Hour Division (WHD) managers and investigators in review of claims of employment retaliation. She also was lead enforcement of non-immigrant visa program matters on behalf of the Denver Solicitor’s Office, representing the Southwest Region of the WHD in nine states. With strong knowledge on the enforcement of non-immigrant visa programs, Courtney successfully resolved all matters (more than 200) over a nine-year span without going to trial.
