Partners Victoria Weatherford and Kyle Cutts authored an article titled “Could bellwether trials be answer to onslaught of mass arbitrations,” published June 14, 2023, by Westlaw Today.
In the article, they write that a great deal of conversation has recently focused “on the use of bellwether proceedings to assess, value, and resolve mass arbitrations.” In fact, “The United States Chamber of Commerce Institute for Legal Reform has issued an 80-page report raising the alarm about the practice of compiling and simultaneously filing hundreds or thousands of individual arbitrations against the same defendant, thereby requiring the defendant to pay arbitration fees that can approach millions of dollars (or more).”
