In a Nov. 10 article titled “Beyond the DPF: A Look at Global Data Transfers Mechanisms for E-Discovery,” Legaltech News reported on a recent panel discussion held as part of Georgetown University Law Center’s annual Advanced eDiscovery Institute.

Partner Nichole Sterling took part in the discussion, titled “Navigating the Cross-Border Data Maze: Global eDiscovery in an Era of Fragmented Regulations,” and is quoted in the article.

As she explained to program attendees, considerable compliance obligations are associated with the new EU-U.S. Data Privacy Framework (DPF), including with regard to onward transfer obligations, such as when an entity receives data and needs to pass it on as part of a discovery request. The onward transfer obligation is “a contractual obligation under the SCCs [Standard Contractual Clauses] and under the DPF. That is probably not going to make a lot of parties happy in litigation to have to sign a contract with each other about what you can do with the data,” Sterling said.
