Partners Andreas Kaltsounis and Nichole Sterling authored an Aug. 4 Law360 article about new “geofencing bans” that are taking effect in four states – Connecticut, Nevada, New York and Washington. These laws limit spatial and location tech around facilities that provide certain healthcare services to prevent people from being identified (or their private information collected and/or shared) when they use those facilities.

According to the article, these laws vary widely, with each presenting unique compliance challenges. The authors caution that “organizations using geofencing tools in these four states should evaluate their exposure to these laws to reduce potential regulatory and litigation risks.”
