Partner Scott McIntyre was quoted in a June 15, 2023, Law360 article titled “Home Care Wage Issues Persist Amid Changing Landscape.” The article addresses lawsuits being brought across the country by workers and the U.S. Department of Labor, who are making overtime violation and other wage and hour claims against home healthcare providers.
The article says multiple issues are creating unique challenges for the industry. These include changing regulations, differing requirements from jurisdiction to jurisdiction, joint employer questions, and long shifts.
“It’s dealing with care, and the hours necessarily can be variable and there can even be overnight care,” McIntyre told Law360. As well, jurisdictional issues arise when aides working in different jurisdictions seek to bring their claims together, he said.
