Partner Ken Reisenfeld will take part in Washington Arbitration Week, appearing Nov. 30 on a panel titled “Bifurcation (or Trifurcation?) in Investment Arbitration – A Success Story? What Have Been the Impacts on Efficiency and Costs?”
Tribunals may choose to bifurcate or trifurcate investment arbitrations to achieve goals of fairness, equality of arms, efficiency or decreased costs. Reisenfeld and his co-panelists will explore whether tribunals should take such actions, knowing that a failed bifurcation can lead to extensive lengthening of a proceeding, decreased efficiency and increased costs for all parties.
