Partners Winston Kirton and Randy Shaheen spoke Oct. 4 at the Council for Responsible Nutrition’s 2023 Now, New, Next conference in Dana Point, California. Titled “FTC’s New Health Products Guidance: What Changed and What Can You Still Say About Your Products,” their presentation addressed a number of changes relevant to the dietary supplement and functional food industry, including a broadening of the Federal Trade Commission’s 1998 dietary supplements guidance and the formalizing of existing FTC positions.
They also discussed matters of ongoing relevance to the industry. Among other things, the Food and Drug Administration (FDA) continues to partner with the FTC on warning letters regarding dietary supplement claims; and health claims that do not meet the FDA’s “significant scientific agreement” standard may be considered deceptive, unless limitations or uncertainty in the supporting science are clearly communicated to consumers and noticed and understood by them.
