Carl Hittinger coauthored a commentary for the Antitrust Litigation Reporter by Thompson/West in March 2008 on the Department of Justice’s Antitrust Division initiation of a corporate leniency program that provides incentives for companies engaged in illegal and anticompetitive activities to self-report the activity. The commentary ("Company Uses Antitrust Amnesty Agreement As Shield Against DOJ"), discusses recent cases that called the program into question and answered questions regarding the binding nature of contracts formed pursuant to the corporate leniency program.
