Partner Carl Hittinger is quoted in an Aug. 29 Legal Dive article about the impact on companies of increasing antitrust scrutiny by the Federal Trade Commission (FTC) and the Justice Department (DOJ).
The FTC and DOJ revised Hart-Scott-Rodino requirements in June and proposed new merger guidelines the following month, according to the article. “The changes are part of the federal government’s stepped-up effort to curb mergers on antitrust grounds.”
“It remains to be seen how the courts will view” the government’s proposed 30% market concentration threshold for opposing a merger, Hittinger told Legal Dive.
