An Overview of the Government’s Enforcement Remedies and Proactive Strategies to Anticipate, Mitigate and Defend FCA Civil, Criminal, and Debarment Actions
The government’s enforcement environment, which includes the civil False Claims Act (FCA), criminal prosecution, suspension and debarment, and contractual remedies, can pose complicated, expensive, and potentially ruinous consequences for government contractors. This CLE program invites federal contractors to consider a more dynamic, proactive approach by implementing values-based ethics and compliance programs and building a robust response protocol to both mitigate the occurrence of such events and, as they occur, to effectively manage and defend parallel proceedings when the government pursues such remedies simultaneously.
This CLE program will discuss:
- An overview of the government’s enforcement remedies and environment
- Best practices in values-based ethics and compliance programs
- An overview of internal investigations involving allegations of procurement-related misconduct
- Disclosing events to the government, including mandatory and voluntary disclosures
- Navigating the suspension and debarment system in this environment
