Partner Carl Hittinger was quoted in a Jan. 6, 2023, Global Competition Review (GCR) article titled “Oversight report: FTC and DOJ usually stay in their lane.”
Hittinger told GCR that despite a 2016 agreement establishing a process to address jurisdictional overlap, it can still be challenging to determine whether the Federal Trade Commission or Department of Justice will take the lead on investigating a given deal. And recent efforts by both agencies to increase enforcement could make that challenge worse, he said.
