Associate Sean Killeen represented Hill Farrer & Burrill LLP in a proposed class action brought by a plaintiff who alleged that the client had failed to stop a preventable cyberattack that affected her personal information. In a tentative ruling ahead of a hearing on the law firm’s demurrer to the complaint, Los Angeles Superior Court Judge David S. Cunningham III also would not allow for the complaint to be amended because the case law cited by the lead plaintiff was deficient. He made the tentative ruling that the demurrer should be sustained without leave to amend final after hearing oral arguments. Law360 had an article on the case titled “Hacked LA Law Firm Hill Farrer Beats Suit Over Cyberattack” which was published on Jan. 7, 2024.
In an interesting side note, the lead plaintiff in the suit was also the plaintiff in another case in 2020 where Hill Farrer represented the defendant, her former employer.
