House Republicans have introduced a plan they say will strengthen election integrity. The American Confidence in Elections (ACE) Act comprises dozens of bills previously introduced individually, according to a July 17, 2023, Tax Notes article titled “Bill Would Curb IRS Oversight of EO Donors, Political Activity.”

In comments to Tax Notes, Partner Alexander Reid took issue with a number of provisions in the proposed law, including one that would raise the IRS gross receipts filing requirement threshold from $5,000 to $50,000. Another provision, according to the article, “would prohibit Treasury and the IRS from publishing new or revised guidance on whether a social welfare organization is operated exclusively to promote section 501(c)(4) purposes.”

In essence, Reid said, the proposed law treats “nonprofits instrumentally rather than with respect, as conduits for campaign money rather than as mission-driven enterprises.”

“Donor anonymity should be respected to prevent viewpoint discrimination, retaliation, and harassment,” he added, “but it should not be used to hide waste, fraud, and abuse.”
